User Agreement

Effective Date: September 28, 2025

This User Agreement ("Agreement") sets forth the terms and conditions governing your use of The NIEA App ("we", "us", "our"), including all features, content, and services provided through our mobile and web applications. By accessing or using The NIEA App, you agree to comply with this Agreement. If you do not agree, do not use the app.

1. Acceptance of Terms

• You must be at least 13 years old to use The NIEA App. If under 18, parental or guardian consent is required.
• By registering, accessing, or using the app, you accept and agree to be bound by this Agreement and all applicable policies.

2. User Responsibilities

• Provide accurate, complete, and current information during registration and use.
• Maintain the confidentiality of your account credentials and restrict access to your account.
• Immediately notify us of any unauthorized use or security breach.
• Comply with all applicable laws, regulations, and community guidelines.

3. Content & Intellectual Property

• You are solely responsible for all content you upload, share, or interact with in the app.
• Content must not violate the rights of others, contain prohibited material, or breach any law.
• By submitting content, you grant The NIEA a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the app for its intended purpose.
• All app content, trademarks, and technology are owned by The NIEA or its licensors and protected by intellectual property laws. You may not copy, modify, or distribute without written permission.

4. Prohibited Activities

• Do not engage in unlawful, harmful, abusive, fraudulent, or disruptive behavior.
• Do not harass, threaten, or harm other users.
• Do not upload viruses, malware, or any harmful code.
• Do not attempt to gain unauthorized access to accounts, data, or systems.
• Do not use the app for commercial solicitation or spamming.

5. Account Suspension & Termination

• We reserve the right to suspend or terminate your account or access to the app at our discretion, with or without notice, for violations of this Agreement or our policies.
• Upon termination, your right to use the app ceases immediately. Certain provisions of this Agreement will survive termination.

6. Privacy & Data Protection

Your use of The NIEA App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

7. Third-Party Services

The NIEA App may integrate with third-party services (e.g., AWS, authentication providers, analytics). We are not responsible for the content, policies, or practices of these third parties. Your use of third-party services is subject to their terms.

8. Disclaimers & Limitation of Liability

• The NIEA App is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not guarantee uninterrupted, error-free, or secure operation of the app.
• To the maximum extent permitted by law, The NIEA and its affiliates are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the app.

9. Indemnification

You agree to indemnify, defend, and hold harmless The NIEA, its officers, employees, and partners from any claims, damages, liabilities, costs, or expenses arising from your use of the app or violation of this Agreement.

10. Dispute Resolution

Any disputes arising from this Agreement will be resolved in accordance with applicable laws and through good faith negotiations. If unresolved, disputes will be subject to the jurisdiction of the courts in the State of [Your State], United States.

11. Changes to Agreement

We may update this Agreement at any time. Changes will be posted on this page with a revised effective date. Continued use of the app constitutes acceptance of the updated Agreement.
